12-Hour Shift Schedule
 
 
 
 
 

A. INTRODUCTION

The Company offers 12-hour work shifts for employees when the following conditions are met:

1) The work group has 24 hour coverage responsibilities; and,

2) the Company's basic operating needs can be met.

B. Meeting Company Operating Needs

To ensure that the 12-hour shift allows the Company to meet its basic operating needs, the following principles must be satisfied:

1) Existing policies and benefits remain essentially the same as under the 8-hour shift schedule.

2) Absenteeism, tardiness and turnover must not significantly increase.

3) Overtime, job coverage and operations efficiency and effectiveness must not be  negatively impacted.

4) Safety records must not be adversely affected.

5) Costs will not increase. Payroll costs and benefits remain essentially the same as under the 8-hour shift schedule.

6) The schedule must have the acceptance and overall support of employees as indicated by the appropriate union representatives.

The 12-hour Shift Schedule will be subject to cancellation by management at any time if operating or related conditions warrant.

C. TRIAL PERIOD

Once instituted in a new work group, the 12-hour Schedule will proceed on a trial. basis not to exceed six months. Toward the end of this period, the Company will evaluate the program as to its continuing acceptability to employees and continued efficient, safe operations. The Company will then determine if it should be offered, at management discretion, on a permanent basis.

D. LOCAL ISSUES

Due to the varying effects working an extended day will have on operations, many of the issues essential to the success of the 12-1-cur day will be decided on a local basis (work schedules, on-call schedules, etc.) within the parameters of this agreement.

 PAY RATES and CLASSIFICATIONS

The hourly and weekly pay rates covered under the provisions of the 12-hour Shift concur with the April 1, 1988 Union Agreement. These rates are exclusive of premiums paid for-shift differential and Sunday premium.

WORK SCHEDULES

Twelve hours shall constitute a regular day's work, and 40 hours shall constitute a regular week's work. Except in special situations, the regular bi-weekly work schedule shall consist of three scheduled workdays (36 hours) in the first week and four scheduled work days (4-8 hours) in the second week. The actual start-time will be decided on a local basis.

G. OVERTIME PAY

Overtime and other premiums paid under these provisions shall in no manner be duplicated or pyramided for the same hours worked.

Employees who work a 12-hour shift on a relief or temporary basis are paid overtime in accordance with this section.

Under some conditions, an employee may be required to remain on duty continuously beyond his regular scheduled workday. in such instances, an employee will be paid overtime pay at time-and-.one-half his base rate for the first two (2) hours of extended day overtime If an employee is required to remain on duty beyond the first two (2) hours of overtime, then such additional hours of work shall be paid at double-time his base rate of the employee.

Except as noted above, all hours worked in excess of 40 hours in a workweek shall be paid at time-and-one-half the base rate. Only time worked on the regular 12 hour rotating shift shall count towards accumulating the 40 straight time hours.

H. NIGHT PREMIUM AND SUNDAY PREMIUM

Employees who are scheduled and who work during the night shift shall receive premium pay at the rate of $.67 per hour for hours worked. The night shift shall be defined as any 12-hour shift including 12:01 a.m.

Employees who are scheduled and who work an Sunday will receive pre== pay at the rate of $1.52 per hour worked on such schedule

Employees who are scheduled and who work during the night shift on Sunday will receive the shift premium in addition to the Sunday premium.

Split days off premiums do not apply where at least two days off in a row are achieved in the work week.

ENTITLEMENTS

All vacation allowances accrued under the 8-Hour schedule will be converted to the 12-Hour Schedule on an hour-for-hour basis.

All sickness allowances accrued under the 8-hour schedule will be converted to the 12--Hour Schedule on an hour-for-hour basis.

All Bereavement/Emergency illness time allowed under the 8-hour schedule will be converted to the 12-hour Schedule on an hour-for-hour basis.

J. ON-CALL

A relief procedure will be used for staffing unscheduled vacancies because a full double shift ("hold-over") cannot be worked, except in emergency situations.

Relief Procedure

The relief procedure will place a sufficient number of employees to on-call" at the time of a shift change so that all positions on the shift are backed up by an employee on-call. All employees are available for on-call.

The on-call period will be one-hour. The pay for on-call will be $5.00 per period served.

The on-call period can be placed anywhere within a two hour window which extends from one hour prior to the starting time for a shift and ends one hour after the starting time for a shift. The placement of the one hour on-call period within the two hour window will be determined by local agreement.

Stand-by

When a supervisor needs time to make a determination on workforce requirements, the supervisor may place the on-call employee on stand-by status. Stand-by status would last for no more than 2 hours from the time of the phone call. Pay for stand-by would be at the rate of time and one half. Contact for stand-by status shall be made during the on-call period only. Stand-by time is not to be counted towards double--time pay.

K. MODIFICATION CP SCHEDULES

If, with less than 24 hours of notice, an employee is called out to work prior to his regularly scheduled shift, and the new starting time is two hours or less earlier than his regular starting time, then overtime shall be paid at the rate of time-and-one-half his base pay for such hours.

L. REST PERIODS

The employee will be paid at double time if the time not worked (release time) between the two shifts does not total eight hours. If the employee has been called out on short notice, travel time is not included in the eight hours.

M. MEAL ALLOWANCES

The provisions of the Agreement for providing an employee a meal allowance apply. An employee must work thirteen hours and 45 minutes consecutively or more to be eligible for the meal allowance.

N. HOLIDAY PAY

To maintain an equivalent number of holiday hours under the twelve hour day (104 hours), the number of holidays will be reduced from 13 to 9. The employees will be allowed 8, 12-hour holidays plus 8 hours of holiday pay for New Years Day, Four hours of vacation pay will automatically be applied to the New Years Day holiday to provide the employee with a total of 12 hours of pay. The holidays are-.

- New Years Day                     - Labor Day
(8-hours holiday + 4 hours        - Thanksgiving Day
of vacation pay)                        - Day after Thanksgiving
- M. L. King Jr. Birthday          - Day before Christmas
- Memorial Day - Christmas
- Independence Cay

If a holiday occurs on the fourth or last day of the week that four days are scheduled to be worked, the employee shall receive an additional day of paid vacation allowance (12 hours) unless it is New Years Day, in which case the employee will receive an additional 8 hours of vacation time. '

JURY DUTY

An employee scheduled for jury duty will be assigned to a Monday through Friday 12-hour day shift during the period of Jury Duty. This schedule would be a three day, 36 hour workweek or a four day, 48 hour workweek, depending on the employees pre-existing work schedule.

Time off with pay is only granted for one jury service in any two-year period.

P. TRANSFERS IN/OUT

Both groups and individual employees will be allowed to transfer to or from 12-hour schedule assignments on any Saturday date. Sat@=day is de-Fined as the first day of the workweek. Special handling of 90 day return requests will ensure that employees will earn 40 hours of pay for the week since an employee transferring out may lose some hours in a biweekly period because of less than 40 hours worked under the 36/48 hour combination schedule.

12-HOUR SHIFT SCHEDULE
 
 

This serves as a revision and addendum to the Agreement on the 12-Hour Shift Schedule dated August 4, 1988, between Southern California Gas Company and Locals 132 and 483 of the Utility Workers Union of America, AFL-CIO:
 
 

1. Revise Paragraph 0 - JURY DUTY, to read;

While serving on jury duty, an employee shall be assigned to a Monday through Friday day shift consisting of five eight-hour days. Time off with pay is only granted for one jury service in any two-year period.
 
 

2. Add Paragraph Q - CONSECUTIVE-DAY RULE, as follows:

The provisions of Section 6.06(B) of the Agreement Respecting Rates of Pay and Other Conditions of Employment dated April 1, 1988, shall apply to employees who are scheduled to work 12-hour shifts under the provisions of the Agreement on the 12-Hour Shift Schedule dated August 4, 1988.
